The Claims
DePuy class action lawsuit claimed some patients suffered after having one of the two allegedly defective systems (ASR™ XL Acetabular Hip System or ASR™ Hip Resurfacing System) implanted. Harm included premature revision surgery.
The Class
Consumers who are residents of Canada — excluding British Columbia and Québec — who had an ASR™ XL Acetabular Hip System or ASR™ Hip Resurfacing System surgically implanted in them in Canada.
Updates
- On August 27, 2013, class action certified by the Ontario Superior Court.
- On April 9, 2021, a proposed settlement was reached, which includes the creation of a $15.5 million CDN settlement fund that will be used to pay compensation to eligible Class Members as well as legal fees and other deductions. In order for the proposed settlement to be effective, it must first be approved by the Ontario Superior Court of Justice.
- On October 6, 2021, the Ontario Superior Court of Justice approved a $15.5 million class action settlement between DePuy and consumers who were surgically implanted with certain versions of the company’s metal on metal hip implants. The claims period closed on March 14, 2022.
