Frequently Asked Questions

The personal injury team at Rochon Genova helps accident victims and their families address the physical and financial obstacles they face by advocating for their rights, in and out of the courtroom. We treat clients with respect and dignity and provide clear, comprehensive, and effective legal advice.

Our office is located at 121 Richmond Street West in downtown Toronto, but we provide our services to clients across Ontario. We have clients from Ottawa to London to Niagara and everywhere in between. We will meet seriously injured accident victims in their homes or hospital rooms. No matter where you are located, we can discuss how best to meet with you and discuss your case.

We represent clients who have suffered serious and permanent injuries, including brain injuries, spinal cord injuries, amputations, nerve damage, and orthopaedic injuries such as fractures and joint separations. Our personal injury team has decades of experience helping accident victims pursue compensation for many types of injuries.

First, seek medical attention. It is important that you get a proper diagnosis of your injuries and receive medical treatment promptly. Even if you feel fine, it is important to get checked by your doctor so that there is a medical record of what happened. Your treating doctor may identify a health issue or impairment that you may not have noticed in the wake of your accident.

Second, report your accident. Make sure there is a police report or some record of the incident that includes details like what happened, when it happened, and who witnessed it. Take and keep photographs of the accident scene, damage to the vehicles, damage to personal property, and visible injuries. Ensure that you collect the contact information of any witnesses and other people involved.

Third, provide notice of your accident to your insurance company. There may be time limits involved, so make sure you provide notice as soon as possible.

As soon as you are able, contact us to discuss your case.

As a general rule, you have two years from the date of an incident to bring legal action. This time period may be extended depending on the facts of your case. In cases that involve negligence on the part of a city or municipality, there may be short deadlines, sometimes as short as 10 days from the date of the accident. It is always best to contact a lawyer as soon as possible after a personal injury to ensure that you protect your legal rights.

If you have been in a car accident, you should also inform your accident benefits insurer of the accident within seven days of it happening and complete the accident benefits application within 30 days of the accident.

Each case has unique facts and different outcomes. However, you may be able to recover compensation for pain and suffering; loss of past and future income; lost education; housekeeping and home maintenance expenses; future medical expenses; rehabilitation expenses; and special damages, which can include out-of-pocket expenses incurred as a result of the accident.

It is impossible to know what your claim is worth without considering a wide variety of factors, including the extent of the injury, the final prognosis, the economic consequences of the harm caused, and any legal restrictions on recovery. Our personal injury team will meet with you to discuss the specific facts of your case and the factors that may affect your claim.

The litigation process in Ontario can be lengthy. Many personal injury cases in Ontario take one to three years to resolve. If your case goes to court, it may take longer. The amount of time the claim takes depends on factors such as the age of the injured person, how soon they recover from their injuries, when we receive information about what the future holds for the injured person, and court schedules.

We do not charge a fee for our initial consultation.

At our initial meeting with you, we will discuss our fees as well as any potential expenses associated with pursuing a personal injury claim. If you retain Rochon Genova, you will be provided with a copy of our retainer agreement, which clearly describes the services we provide and all the fees we may charge.

We offer clients different fee arrangement options, ranging from formal contingency fee agreements to pay-as-you-go arrangements. We will discuss with you the pros and cons of our different fee arrangements and help determine what works best for you in your specific circumstances.

We believe that a properly informed client becomes a satisfied client, and we will do our best to explain legal fees in a way that ensures you understand the process.
