The Claims
The Class Action alleges that the Defendants, Intuit Canada ULC and Intuit Inc, falsely, misleadingly and deceptively advertised TurboTax as a free product, contrary to the Ontario Consumer Protection Act (the “ONCPA”) and analogous provincial and territorial legislation and the federal Competition Act.
Based on the Defendants’ false and misleading advertisement that consumers could use TurboTax to file their taxes for free, it is alleged that Class Members sought out the TurboTax platform and used TurboTax for filing. The claim also alleges that after spending significant time and effort in using the TurboTax platform and inputting their personal and sensitive financial information, consumers were alerted that they needed to pay a fee before they could file their tax returns, contrary to the Defendants’ representations.
The Class
All consumers who purchased the TurboTax online software, and any related services, to prepare and/or file their Canadian taxes during the Class Period (the period beginning on January 1, 2015), and their estates, executors, successors, or assigns, other than Excluded Persons.

- On August 25, 2022, the class action was commenced.
- On July 24, 2026, the action was certified.
