The Claims

The claim, filed with the Ontario Superior Court of Justice, alleges that the Defendants knew or ought to have known that ingesting Oxycontin® leads to drug dependency and addiction. Oxycontin® is a narcotic frequently prescribed as a pain-killer. It was approved for use in Canada in 1996. The serious problems associated with ingesting Oxycontin® are alleged to have been well-known to the Defendants for several years. In May 2007, Purdue Pharma LP and some of its senior executives agreed to pay over $600 million in penalties in the United States for misleading consumers and physicians about the addictive properties of Oxycontin®. Some of those senior executives also pleaded guilty to criminal charges in the United States.


The Class

Anyone who was prescribed and ingested OxyContin and/or OxyNEO in Canada between January 1, 1996, and February 28, 2017.

Estates of deceased Canadian Oxy users are also eligible to file claims, as are spouses, children, and certain other family members.


Updates

  • On June 8, 2007, the class action was commenced.
  • On March 8, 2017, the parties reached an agreement to settle.
  • On July 19, 2017, Justice Belobaba of The Ontario Superior Court of Justice approved the Settlement Agreement for the Oxycontin Class Action.
  • On September 23, 2022, Chief Justice Popescul of the Saskatchewan Court of King’s Bench released his written decision approving the OxyContin® and OxyNEO® National Settlement Agreement as being fair, reasonable and in the best interest of Class Members.
  • The deadline to submit claims to collect settlement funds was February 27, 2024.
