The Claims
The action alleges that the defendants negligently designed, manufactured, marketed, distributed, and sold chemical hair straightening products in Canada without conducting reasonable safety testing or providing adequate warnings about the alleged risk of hormone-related cancers and fibroids. The plaintiffs seek damages on behalf of consumers and eligible family members.
Products at issue include – L’Oréal: Dark & Lovely; Dark & Lovely Beautiful Beginnings. Strength of Nature/Godrej: Motions; Soft & Beautiful; Just for Me; TCB; TCB Naturals; African Pride; African Pride Dream Kids. Dabur/Namaste: Olive Oil Relaxer; Olive Oil Girls; Organic Root Stimulator; Original Root Stimulator; Organic Root Stimulator Olive Oil Relaxer (ORS). Sally Beauty: Silk Elements.
The Class
The proposed class includes: (1) all persons in Québec who used the defendants’ hair straightening products (and, where deceased, their heirs and estates), together with specified family members; and (2) all persons in Canada who used hair straightening products manufactured, distributed, and/or imported by L’Oréal Canada Inc. (and, where deceased, their heirs and estates), together with specified family members.
